1. Introduction

Welcome to FinCon Ltd. (“FinCon”, “we”, “our”, or “us”), a software and financial technology company incorporated in the Republic of Ghana. We develop bespoke fintech platforms, web and mobile applications, and enterprise software solutions.

By accessing our website at finconghana.com.gh or using any of our products, platforms, or services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please discontinue use of our Services immediately.

2. Definitions

  • “Client” means any individual, business, or organisation that engages FinCon for software development or other services.
  • “User” means any person who visits our website or uses any FinCon-built platform.
  • “Software Services” means software design, development, integration, deployment, and support services delivered by FinCon.
  • “Platform” means any web or mobile application developed and managed by FinCon.

3. Use of Our Website & Services

You agree to use our website and Services only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Services in any way that violates applicable Ghanaian or international laws or regulations.
  • Transmit or upload any material that is unlawful, defamatory, fraudulent, or harmful.
  • Attempt to gain unauthorised access to any part of our systems, servers, or databases.
  • Use any automated scraping, crawling, or data-mining tools on our website without prior written consent.
  • Impersonate any person or entity, or falsely represent your affiliation with FinCon.
  • Interfere with the security or integrity of any of our systems or networks.

FinCon reserves the right to suspend or terminate access to any User or Client who breaches these Terms.

4. Software Development & Technology Services

Engagements for software development, consultation, or related technology services are governed by a separate written agreement (Statement of Work / Service Agreement) between FinCon and the Client. These Terms apply in addition to any such agreement. Where there is a conflict, the terms of the signed agreement shall prevail.

4.1 Intellectual Property

Unless expressly agreed otherwise in writing, FinCon retains all intellectual property rights in all tools, frameworks, methodologies, and pre-existing codebase used in delivery. Upon full payment, Clients receive a licence (or agreed transfer of rights) to the deliverables as specified in their contract.

4.2 Deliverables & Timelines

Estimated timelines are provided in good faith. FinCon shall not be liable for delays caused by incomplete or late Client input, third-party dependencies, or force majeure events.

4.3 Support & Maintenance

Post-delivery support is subject to a separate support agreement. FinCon does not guarantee indefinite maintenance of delivered software unless contractually committed to do so.

5. Fees & Payments

Fees for Software Services are as agreed in the relevant proposal or service agreement.

  • All fees are quoted and payable in Ghanaian Cedis (GHS) unless otherwise agreed.
  • Software project invoices are due within the period stated on the invoice. Late payments may attract interest at the rate of 2% per month.
  • FinCon reserves the right to suspend services for overdue accounts.
  • Refunds for software services are subject to the terms of the individual project agreement.

6. Privacy & Data Protection

FinCon is committed to protecting your personal data in accordance with the Ghana Data Protection Act, 2012 (Act 843). We collect, process, and store personal information only as necessary for the delivery of our Services.

  • We do not sell or rent personal data to third parties.
  • You have the right to access, correct, or request deletion of your personal data by contacting us at info@finconghana.com.gh.
  • By using our website, you consent to the use of cookies for analytics and functionality purposes. You may disable cookies in your browser settings.

7. Disclaimer of Warranties

Our website and Services are provided on an “as is” and “as available” basis. FinCon makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice.

8. Limitation of Liability

To the fullest extent permitted by law, FinCon Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services, including but not limited to loss of revenue, data, goodwill, or business opportunities.

FinCon’s total liability for any claim arising from Software Services shall not exceed the total fees paid by the Client in the three (3) months preceding the event giving rise to the claim.

9. Third-Party Links & Services

Our website may contain links to third-party websites or services. These links are provided for convenience only. FinCon has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. We encourage you to review the terms of any third-party service you access.

10. Changes to These Terms

FinCon reserves the right to amend these Terms at any time. Updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of our Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of Ghana.
